California Auto Insurance Coverage Guide: Collision, UM/UIM, UMPD and MedPay

California driver reviewing auto insurance coverage after a car accident

The policy that pays first is not always the only coverage available after a California accident. Liability, collision, uninsured or underinsured motorist coverage, uninsured motorist property damage, and medical payments coverage protect different people and different losses.

Understanding the declarations page can reveal options that a quick conversation with an adjuster may overlook. This guide uses simplified examples; your policy language controls.

Liability coverage

Liability coverage helps pay for bodily injury and property damage caused to others when the insured is legally responsible. California’s current minimum private-passenger limits are commonly expressed as 30/60/15: up to $30,000 for bodily injury to one person, $60,000 total bodily injury per accident, and $15,000 for property damage.

Those limits may be inadequate when someone needs surgery, misses substantial work, or has permanent symptoms.

Collision coverage

Collision coverage pays for covered damage to your insured vehicle from contact with another vehicle or object, regardless of who caused the crash, subject to the deductible and policy terms. Your insurer may later seek reimbursement from the at-fault party through subrogation.

Uninsured and underinsured motorist coverage (UM/UIM)

Uninsured motorist bodily injury coverage may apply when an at-fault driver has no applicable liability insurance. Underinsured motorist coverage may apply when the at-fault driver has insurance but not enough to cover the injury claim. California insurers must offer this protection with auto liability coverage; a consumer who declines it generally signs a waiver.

UIM limits generally do not simply stack on top of the other driver’s limits. The at-fault bodily-injury payment is typically credited against the UIM limit. The California Department of Insurance auto coverage guide provides consumer definitions of these coverages.

Uninsured motorist property damage (UMPD)

California’s UMPD coverage can pay limited vehicle damage caused by an identified uninsured at-fault driver. The California Department of Insurance lists a $3,500 limit and notes that a consumer may not need UMPD if collision coverage applies. Hit-and-run property-damage rules can differ, so check the policy promptly.

Medical payments coverage (MedPay)

MedPay can cover limited accident-related medical expenses for an insured and passengers regardless of fault, up to the purchased limit. It can sometimes help with deductibles, copays, ambulance bills, or early care while the liability claim remains unresolved. Reimbursement and lien provisions should be reviewed.

Hypothetical example: $30,000 liability plus $70,000 UIM

Assume Maria is struck by a negligent driver who carries California bodily-injury limits of $30,000 per person and $60,000 per accident. Maria has a serious shoulder injury, follows medical advice, and eventually needs surgery. Her documented damages reasonably exceed $100,000. She also has $100,000 in UIM bodily-injury coverage.

After the at-fault insurer pays its $30,000 per-person limit, Maria presents a UIM claim to her own insurer. Because the $30,000 payment is credited against her $100,000 UIM limit, up to $70,000 remains potentially available under the UIM coverage. In this fictional example, the evidence supports payment of that $70,000, creating $100,000 in combined liability and UIM proceeds before attorney fees, costs, medical liens, reimbursement claims, or other deductions.

This is an illustration, not a promised outcome. Coverage, valuation, offsets, exclusions, consent requirements, causation, and damages can change the result.

Why a lawyer can help find and use coverage

A lawyer can request policy information, review declarations and endorsements, coordinate third-party and first-party claims, document injuries and future care, preserve UIM rights, address liens, and challenge undervaluation. This is particularly useful when an adjuster focuses only on the at-fault driver’s minimum policy and does not evaluate other coverage.

Do not sign a bodily-injury release until you understand what claims it resolves and whether other coverage requires notice or consent.

Frequently asked questions

Is “full coverage” a specific policy?

No. It is an informal phrase. Review the declarations page for the actual liability, collision, comprehensive, UM/UIM, UMPD, MedPay, rental, and deductible amounts.

Can I use collision coverage when the other driver caused the crash?

Often yes, if you purchased collision coverage and the loss is covered. Your deductible and policy apply, and your insurer may pursue the at-fault party.

Why does $100,000 UIM sometimes provide only $70,000?

If the at-fault driver pays $30,000, that amount is generally credited against a $100,000 UIM limit, leaving up to $70,000 rather than adding a separate $100,000.

Does MedPay depend on fault?

MedPay generally covers eligible accident-related medical expenses regardless of fault, up to the policy limit and subject to the contract.
